Terms of Servcie
I provide creative and multimedia services, including:
- Graphic Design – Branding, marketing materials, digital graphics, layouts, and other custom designs.
- Illustration – Custom illustrations, including vector-based artwork, caricatures, and other commissioned artwork.
- Photography – Portraits, events, commercial photography, product photography, and other photographic services.
- Videography – Event, promotional, commercial, social-media, and other video production services.
- Chinese & Japanese Calligraphy – Custom calligraphy artwork incorporating traditional and contemporary artistic approaches.
- Drone Photography & Videography – Aerial photography and video services subject to applicable laws, regulations, weather, location restrictions, and safe operating conditions.
Specific services, deliverables, pricing, timelines, and requirements will be agreed upon with the client before work begins.
A project or service is considered booked once:
- The client accepts the proposed scope of work;
- Any required deposit or retainer has been received; and
- Both parties have agreed on the applicable date, time, deliverables, and project requirements.
I reserve the right to decline or cancel projects that conflict with our professional standards, availability, safety requirements, or applicable laws.
All prices will be communicated to the client before work begins.
Depending on the project, payment may include:
- A non-refundable booking fee or deposit;
- Milestone payments; and/or
- Final payment before delivery of final files or products.
Unless otherwise agreed in writing, final deliverables may not be released until all outstanding balances have been paid in full.
Additional services, revisions, travel, rush requests, additional shooting time, specialized equipment, printing, licensing, or other expenses may result in additional charges.
Creative work is subjective. I will make reasonable efforts to create work consistent with the agreed creative direction.
The project may include a specified number of revisions as agreed upon in the project proposal or invoice.
The first three revision are free.
Additional revisions or substantial changes to the original project scope may be billed separately after the third revision.
Changes requested after final approval may also incur additional fees.
The client agrees to:
- Provide accurate information and project requirements.
- Supply necessary materials, logos, photographs, text, references, or other content in a timely manner.
- Obtain permission to use any materials supplied to us by the client.
- Provide reasonable access to locations and subjects when required.
- Review proofs and provide feedback within agreed-upon timelines.
- Obtain necessary permissions for locations, venues, participants, or intellectual property when applicable.
Delays caused by missing information, late approvals, unavailable subjects, or other client-related circumstances may affect the delivery schedule.
Unless otherwise agreed in writing, the creator retains copyright and ownership of original creative works produced as part of the project.
Upon full payment, the client receives the agreed-upon license or usage rights described in the project agreement.
Transfer of copyright or ownership of the original work is not automatically included unless expressly stated in writing.
For graphic design and illustration projects, working/source files such as AI, PSD, INDD, or other editable files are not automatically included unless specifically agreed upon.
The client retains ownership of materials they provide to us.
By providing photographs, logos, artwork, text, trademarks, music, video, or other materials, the client confirms that they have the necessary rights or permissions to use those materials.
The client agrees to indemnify us against claims arising from unauthorized materials supplied by the client, to the extent permitted by law.
Unless the client requests otherwise in writing before the project begins, I may display completed creative work in our portfolio, website, social media, promotional materials, competitions, or other professional presentations.
For confidential, unreleased, or private projects, clients may request that the work not be publicly displayed.
Final files will be delivered in the formats agreed upon during the project.
Delivery timelines are estimates unless a specific deadline is guaranteed in writing.
We are not responsible for delays caused by circumstances outside our reasonable control, including technical problems, weather, venue restrictions, illness, emergencies, third-party services, or client delays.
Because creative services involve reserved time and customized work, deposits and booking fees may be non-refundable.
Cancellation terms will depend on the service and project agreement.
If a project is canceled after substantial work has begun, the client may be responsible for payment for work already completed and expenses already incurred.
Any refund will be determined according to the applicable project agreement and these Terms of Service.
I will not be responsible for failure or delay caused by circumstances beyond our reasonable control, including severe weather, natural disasters, emergencies, government restrictions, transportation disruptions, equipment failure, power outages, or other unforeseen circumstances.
When reasonably possible, we will work with the client to reschedule or provide an alternative solution.
To the maximum extent permitted by applicable law, our liability arising from a service or project will be limited to the amount actually paid by the client for that specific service.
I'am not responsible for indirect, incidental, consequential, or special damages arising from the use of our services or deliverables, except where such limitation is prohibited by law.
By booking or purchasing our services, the client acknowledges that they have read, understood, and agreed to these Terms of Service.
Individual projects may have additional terms contained in a proposal, estimate, invoice, contract, or written agreement. If there is a conflict, the specific written project agreement will control to the extent permitted by law.
